On my SAC, we were told it was 10% speedo error plus 2% leeway at the discretion of the Chief Constable, and that the Chief Constables have all be told not to exercise said discretion.

So it’s 34 in a 30, NIP in post....

Given the speedo error is up compared to maximum speed (it must never under-read) this makes no sense

This has come up several times over the years and never been enforced.
Having spoken to a Procurator Fiscal here his view because of the law of "de minimis" it never will.

If you're clocked by radar at 34 most speedos will be reading around 36 so you know you're well over the limit , you will be at the next red light 10s earlier though.

It was for a very long time 10% of speed, so in a 70mph zone 77, plus 2mph,so you would be prosecuted at 79. That way they could take speedo error and measurement device error into account and still be fairly sure you were definitely speeding. Say speedo +/- 5% and measurement device +/- 5% worse case compounded error = 10% so a 2mph addition just to make sure. Modern measuring equipment will be a lot more accurate, and speedos have always over read although seem to be a bit closer these days. Zero tolerance could never be enforced, but if you go by the car reading for the stated limit you will be well under.

Well there's interesting.

In response to my request for a photo to identify the driver, I received yesterday a letter stating that there had been an error in the ticket and it had been cancelled.....

I am very pleased indeed. Not least because I was bloody sure I wasn't doing 75 in a 60!

Norway is an interesting place to get stopped by the way.
Few years back I cruised past an inocuous Volvo Estate on the motorway. I was driving an 800 bhp Pontiac WRS6 but digging for change in my pockets slowing for a toll station.
Otherside of toll station I got pulled. Unmarked car apparently I was at 150kph and the road had been derated (in Norwegian) from 120 to 80 as it was winter.
I had to follow police to station so they could arrest me!! Judge turned up after an hour, very nice lady.
£800 fine or 2 weeks in jail at a time of my choosing - very civilised. She asked me not to do it again.

Good news....well done.

I presume it is not expected to request a photo of the driver for gantry variable camera's as in my case?

Guessing they have to be aimed at front of car not taken from reR lime gantry ones.

Interesting point as how do they prove who was driving in gantry camera's?

Mine was smart motorway variable exactly like yours. Although I rather doubt it was me that triggered the camera, apart from not generally doing 75 in a 60, the NIP seemed to indicate I was on the northbound carriageway. Which is why I actually asked for the photo

Thanks. I've sent my form back now but I guess I should have asked for proof first. Or can I still do that now? I haven't heard anything back yet.

See what the offer is was what I was going to do.....

I think they will possibly only volunteer the photo if you go to court. Which personally annoys the **** out of me

Thanks...I'll see what goes. Did you send your form back first or anyway or ask for the photo before sending the form back?

I asked for the photo, but then found myself wondering what would happen if the 28 days timed out before I got it. So I sent the form back anyway. Felt like a no-win setup.
