And another 2 months later since the last update.
I do not know about you guys, but I am starting to lose confidence in a happy ending.

I want to thank the persons that have put in all their efforts to get this thing going again, but it really sounds like a deal that went south and the money went up in smoke.

I do not want to insult any person that is trying to help here, but if you look at the facts and the time passed, it really is getting weird.
I hope I am wrong in all this, and that in the disk brake business a few months extra is common.

Has the motor factor that agreed to refund the money actually done so?

If so, Matt, are we to assume it is safely in your account, awaiting the outcome of talks with a different manufacturer?

Just keen to know where my money actually is.

Indeed we are still awaiting the money back from the factors.

Suppose I need to get involved now as MAF is having no joy.

Do we have any solicitors on hear willing to assist?

So now it is clear and in the open: the manufacturer has been paid by MAF, does not deliver, and does not want to refund.
The silent, diplomatic way has not worked (but thanks for that anyway), it is time for action.
As far as I have understood, this order is quit large, so that will be a lot of Phone calls and letters if everybody takes action.

It is time to spill the name of that company that has our money, so we can all contact them. I think the company has forfeited its right to a diplomatic and silent solution.

No. There is a motor factors that sits between MAF and APEC. That is where the issue is.

Regardless of if we get the money back or not you will all be paid out of MAFs pocket. He doesn’t have to do that but that’s the type of persons your dealing with on here.

I would have thought that all is required is a strongly worded letter to the motor factor, stating that if the money is not returned in full within 14 days, that solicitors will be instructed to pursue matters. Let's give the motor factors one last chance to sort things out quickly and cheap. If nothing else such an action stands us in good stead if we go to court as it shows our willingness to be reasonable.

Did MAF pay the motor factors using a credit card? If so, a section 75 claim may be possible.

Ok I asked Sara and while she's happy to help out the firm she works for doesn't allow her to do probate work... but if you want her to recommend someone drop me a PM :)

Yes that's what I meant... they can't do any work on to side free or not.

As I said she would like to help especially as i had my name on the list but Tony swapped his discs took my place. The old firm she worked at will be able to help out but they are Surrey based and will charge but aren't hugely expensive as it's a small firm

Spoke to MAF yesterday he’s already had a solicitor look at it and the sticking point is a lack of paperwork involved in the transaction.

Two previous transactions went okay, the third for a sum in excess of £10k goes wrong. Are we saying the money has just vanished? I would say it’s more a criminal investigation now.

I don’t want MAFs money I want a set of discs or the motor factor to pay me back, or worst case name address and details of these so called motor factors to ‘send the boys round’

I don't have a dog in the fight but I do buy from motor factors during the normal course of business.
I don't want to unknowingly support with further purchases product from a factor who screws over a club I belong to.
Name the company now!

Indeed. Name and shame, so we can all get on their case. There's no need for paperwork - a verbal contract is still a contract (though of course, paperwork helps!). But in reality, there will be paperwork (i.e. bank statement) showing the money going to the factor over a year ago, and what have we got back in return? Nothing. No judge is going to say that that is okay. Bring it on.
