TP car reversed into me at the lights, minor damage, but exchanged reg no, phone no.. The guy was keen to resolve it without going through ins. ???

Although the damage is very minor, the garage want £1400(seems OTT, though I've used them before)
Told TP the cost and unsurprisingly he has not replied, asked for his ins details, but again no reply! No insurance?

If it was my fault I doubt I'd claim, but it wasn't. Looking on my insurers website I made a claim, but stopped when it said:

"You will need to pay the xs and recover it yourself. Also, based on the details of the accident it's likely we won't recover the outlay and your NCD will be affected."

What would you do?

I don't want to pay a £450 xs and not be able to get it back and my premium to shoot up. If U do nothing, I've got a slightly damaged car, and the b****** will do it to someone else!

Hard one. I got hit by TP (thankfully not the GT) and is settled as not my fault (so no excess to pay and no impact on my NCB). However as I drive 4 cars and declare the non fault accident, every premium has gone up by between £250-£400 (verified by doing comparison site check with and without declaring the non fault accident). That means the idiot who hit me is going to cost me over £1000 a year extra to insure my cars for a handful of years, really annoying.

For you that means depending on how many cars you’re insured on, claiming against him could burn the benefits very quickly even if he admits it’s his fault…, not fair but seems to be the way the world works.

First thing I would do is check on line to see if he is actually insured, if he is go through your insurance and get the car sorted.

Hopefully he will report it to his insurance and they might deal direct with you to get the car fixed and you won’t have to pay the excess in advance.

Your problems really start if either
- he is not insured
- he does not report it to his insurance company

It’s a pain, but a risk we take when we drove on public roads.

Hopefully it will sort itself out

It's a pain, I was rear ended at traffic lights 4 years ago.
No fault fully covered by the third party, but insuring 4 cars having to declare the no fault accident is a real pain at every renewal, 4 times a year, for 5 years.
Then some ask what was the cost of the accident...I don't know, it was covered ny the third party!

Checked MID and the car is insured, but unsure if the driver was, and it seems unlikely that I can check this.

I think I may contact my insurer, and without giving any details ask them some questions. Must remember to use Glaswegian accent!

I would be inclined to go through the insurance Brendan. I’ve heard this numerous times where the tp was at fault and said they would pay rather than go through insurance only for them to go back on their word when they see £100 won’t be sufficient to repair the damage. The badge on the car should’ve been enough to realise it was going to be pricey even though minor damage.
Keep to the facts what happen, leave it to them and if they decide to jack the price up too much next renewal I’m sure you will find it cheaper on a compare site.

I actually think insurance companies like these little knocks, they win both ways - if you claim your premiums go up even though you weren't at fault and if you don't they get money for insurance without having to pay out.

Called insurers and it boils down who is at fault, the TP could easily say I hit him, so that I'll lose my XS and NCD. Without any witnesses/dash camera it will be difficult to prove.

Not sure if I'll pursue it, but my blood is boiling at the TP!

Very frustrating.
It's at times like these a dash cam is worth the investment.
Even though when I was rear ended at traffic lights, my dash cam proved that I was stationary when hit, and the third party pushed me into the car in front. Fortunately only a scratch to the car in front and he wasn't interested in any claim from me.
As soon as I made clear I had a dash cam to the third party who hit me from behind, their insurance admitted liability immediately.
Only got the car back a few days and a car reversed into my front wing while parked. The driver could have driven off, but when I came back to my car he was stood next to it, as he saw my dash cam with its recording red light, and he knew it had caught his car reversing into mine.

Need to get a dash cam or two, less of an issue here but useful all the same - any recommendations ?
